Request for Suspension or Revocation of Driver’s License

If officers have reasonable cause to believe
that it is unsafe for a person to operate a
motor vehicle of the type for which the person
is licensed, they may request a suspension or
revocation of the person’s driver’s license.

AUTHORIZATION

Under Section 286-119, Hawaii Revised Statutes,
the examiner of drivers may suspend any driver’s
license without a hearing when the examiner has
reasonable cause to believe that the licensee is
incompetent or is afflicted with mental or physical
infirmities or disabilities that would make it
unsafe to operate the type of vehicle for which the license is held.

When the examiner of drivers suspends a license
under this section, the examiner shall immediately
notify the licensee and afford the licensee a hearing.
After the hearing, the examiner of drivers may rescind
the suspension, suspend the license for a further
period, or revoke the license. Any person whose
license has been suspended or revoked may appeal.
PROCEDURE

A. An officer who has reasonable cause to
believe that a person is unsafe to operate a
motor vehicle of the type for which the person is licensed shall:

1. Not take away the person’s license;

2. Initiate a Miscellaneous Public case, including:

a. The facts relevant in establishing the
reasonable cause for the suspension or revocation of the license;

b. The licensee’s name, address, date of
birth, class of license, restrictions, driver’s
license number, and vehicle description (type
of vehicle, vehicle identification number, and license number); and

c. The disposition marked as “Records/referred
to Chief License Examiner and Inspector;” and

3. Forward a copy of the report to the
officer’s element commander for submission to
the city’s Chief License Examiner and Inspector,
Driver License Branch, Customer Services Department (CSD).

B. Upon receipt of this report, the element
commander or designee shall create a letter on
departmental letterhead requesting that the city’s
Chief License Examiner and Inspector review the
report and take appropriate action. The request
letter and a copy of the report shall be forwarded
to the city’s Chief License Examiner and Inspector,
Driver License Branch, CSD.
