I. Officers are sent to miscellaneous assist
and standby cases for the purpose of helping to
preserve the peace and prevent violations of the law.
II. Officers sent to such cases, either on
private or public property, are not authorized
to provide assistance with noncriminal matters.
III. If the situation at a miscellaneous assist
or standby case involves a criminal matter, the
officers shall exercise their authority under the
law and in accordance with departmental guidelines.
BACKGROUND AND GUIDELINES FOR RESPONDING OFFICERS
Officers are often dispatched to private and public
property on miscellaneous assist and standby cases.
The purpose in sending officers to such cases is to
help prevent breaches of the peace and violations of the law.
However, in some cases, officers have been asked
to exceed their authority by assisting in the
performance of a civil function at the case site,
e.g., by aiding private security personnel in the
performance of their duties.
Officers sent to such cases shall inform whoever
requested them that the police are not authorized
to provide assistance with noncriminal matters.
In particular, police are not authorized to assist
or substitute for security personnel in the
performance of civil functions.
Officers at miscellaneous assist or standby cases
can act only as necessary to prevent a breach of
the peace or a violation of the law. If a criminal
act occurs, officers shall respond in accordance
with the law and departmental guidelines.
These instructions do not apply to the service
of temporary restraining orders and other court
orders by Honolulu Police Department officers.
