I. Refuse violations reported to the
Honolulu Police Department (HPD) shall be
handled in accordance with this policy.
II. Chapter 42, Article 6, Revised Ordinances
of Honolulu, authorizes police officers to arrest
or issue a form of summons or citation to violators of this chapter.
General Complaints
Complaints of refuse collection and disposal
violations received from the public shall be
referred to the Department of Environmental
Services (DES) for investigation and issuance
of warnings. The reporting person shall be
referred to the refuse yard servicing the
location of the complaint.
Requests for Enforcement Action by the DES
A. A DES representative shall request an
officer to take enforcement action for repeat
refuse collection and disposal violations.
B. The assigned officer shall meet with
the DES representative at the scene of the violation.
C. The assigned officer shall obtain a
written HPD Statement Form, HPD-252 form,
from the DES representative, a copy of documented
prior warnings issued to the violator, and
photographs (if available) of the violation(s).
1. The officer shall initiate a miscellaneous
crime report and submit a completed HPD-252 form.
The report shall include the violation, dates and
times of prior warnings, copies of the DES
documentation of warnings issued to the violator,
and photographs (if available) of the violation(s).
If available, the officer shall also submit a
photograph of the current violation with the report.
2. The officer shall issue a citation to the
violator. If the violator is not present, the
case shall be submitted to the respective element’s
Misdemeanor Follow-Up Detail for
follow-up and issuance of a citation.
3. A copy of the completed police report
and citation shall be forwarded to the director
of the Misdemeanor and Traffic Division,
Department of the Prosecuting Attorney.
