Citation and Arrest in City and County of Honolulu Parks and Recreation Facilities

Department personnel shall observe the following
procedures for making arrests and issuing citations
for violations of Chapter 10, Article 1, Revised
Ordinances of Honolulu 1990 (ROH).

BACKGROUND

Chapter 10, Article 1, ROH, addresses the use of
public parks, playgrounds, beaches, and other public
areas under the control, maintenance, and management
of the Department of Parks and Recreation of the
City and County of Honolulu. Included are sections on:

A. Park rules and regulations;

B. Permits;

C. Rules and regulations pertaining to street trees, hedges, and shrubs; and

D. Public beaches.

CITATION

A. A police officer may issue citations
for violations of Chapter 10, Article 1, ROH,
in instances that do not require physical arrest of the violator.

B. When a citation is issued, the officer
shall give a copy of the citation to the violator.
The time and place that the violator is to answer
the charges shall be specified on the citation.
If a juvenile is issued a citation, the disposition
shall be referred to the Department of the Prosecuting Attorney.

l. Whenever a motor vehicle is found with a
driver, the officer issuing the citation shall:

a. Take the name, driver’s license number,
and address of the alleged violator; and

b. Take the license number of the vehicle involved.

2. Whenever a motor vehicle is parked or
stopped in violation of Chapter 10, Article 1,
ROH, and is found without a driver, the officer shall:

a. Take its license number and any other
information displayed on the vehicle which may
identify its registered owner; and

b. Affix the citation to the vehicle.

ARREST

In accordance with Chapter 10, Section 10 1.6,
ROH, an officer may arrest a violator under
any of the following circumstances:

A. The alleged violator refuses to provide
the officer with his or her name and address
and any proof thereof as may be reasonably available to the alleged violator;

B. The alleged violator refuses to cease
the illegal activity after receiving a citation; or

C. The officer has ascertained that the
alleged violator had been cited or arrested within
the past l2 months for the same offense.
