Moped Safety

Operation

  • A moped driver must have a valid driver's license.
  • A moped driver must be at least 15 years of age (18 years with out-of-state license).
  • Parents or guardians are responsible for violations, misconduct, and negligence of minor moped drivers.
  • Traffic laws apply to persons driving mopeds except where special rules apply.
  • A moped must not be driven on a freeway or interstate highway.
  • No passenger may be carried on a moped.
  • Mopeds may not be driven on a sidewalk, a sidewalk area, or any other place intended for the exclusive use by pedestrians.
  • A moped must be driven as near to the right edge of the roadway as is practicable.
  • A moped must not be driven at a speed greater than 35 miles per hour. On a level surface a moped must not be capable of going faster than 30 miles per hour.
  • Mopeds must be driven in single file.
  • Mopeds must use bicycle lanes where provided on a roadway.
  • Mopeds may use bicycle paths except where prohibited by signs.
  • A moped driver must ride astride the seat with one leg on each side of the moped.
  • A moped must not be driven when attached to a vehicle or other transportation device.

 

Registration

  • A moped must be registered with the County director of finance.
  • Dealers must register every new moped sold.
  • A moped must display a current registration decal on the rear fender facing rearward.
  • A moped without a current registration decal is subject to seizure and sale by the police.
  • The fraudulent use or removal of a moped decal is subject to a penalty of $500.00.

Equipment Requirements

  • Motor: maximum two horsepower (one thousand four hundred ninety-two watts, or a maximum of 50 cubic centimeters displacement); may not be modified to increase power.
  • Automatic drive.
  • Brakes on all wheels.
  • Fenders over all wheels.
  • Suitable guards on drive chains or belts and rotating parts.
  • An approved muffler in the exhaust system.
  • A seat or saddle.
  • Headlamp, tail lamp, stop lamp and required reflectors.
  • A speedometer.
  • An electrically actuated horn.
  • A retracting stand.
  • Possession of a moped, a moped motor, or any other moped part with an altered, erased, or mutilated identification or serial number is prohibited.
