Ask HPD: Being Pulled Over


Question: What is a driver's right when he or she is being pulled over? What must the driver do in order to cooperate?

Answer: If you are the subject of the traffic stop, the officer will stay behind you as you yield and follow you to the side of the road. You may be asked by the officer via hand motions, loudspeaker, or in person, to move to a safer location than where you originally stopped. This is both for your safety and that of the officer. Also, please stay in your vehicle unless directed otherwise. It is a violation with a $97 fine to fail to yield to an emergency vehicle, and a petty misdemeanor to disobey the directions of a police officer.
