Q. "Is playing online poker, with real money, a crime if I'm residing in Hawaii?"

A. Gambling is illegal in Hawaii and the laws also apply to gambling sites. If one or more of three elements occur, then it is considered gambling in Hawaii. The three elements are consideration, a contest of chance, and reward.

Consideration would be if a person had to pay a fee or purchase something to enter.
Contest of chance refers to a game in which winners are determined by a chance event.
Reward is if the person won cash or a prize. Those found guilty of violating state gambling laws may be subject to jail time and fines.
