Ask HPD: Littering

Q. "I saw a driver litter. What is the law?"

A. Litter is rubbish, waste material, or debris of any kind whether it has value or not. It is unlawful for anyone to throw or drop litter from a vehicle on any highway. So something as small as dropping a cigarette butt or a banana peel from a vehicle is littering. A conviction for a first offense includes 4 hours of picking up litter or other community service and subsequent convictions increase to 8 hours. In addition, fines range from $100 to $500. So let's keep our roadways clean by disposing of litter properly.
