Reference §HRS 134-7
No person who is a fugitive from justice shall own, possess, or control any firearm or ammunition therefore.
No person who is under indictment for, or has waived indictment for, or has been bound over to the circuit court for, or has been convicted in this State or elsewhere of having committed a felony, or any crime of violence, or an illegal sale of any drug shall own, possess, or control any firearm or ammunition.
No person who has been acquitted of a crime on the grounds of mental disease, disorder, or defect.
No person who is or has been diagnosed as having a significant behavioral, emotional, or mental disorders as defined by the most current diagnostic manual of the American Psychiatric Association or for treatment for organic brain syndromes; shall own, possess, or control any firearm or ammunition therefore, unless the person has been medically documented to be no longer adversely affected by the addiction, abuse, dependence, mental disease, disorder, or defect.
"Fugitive from justice" means any person
(1) who has fled from any state, territory, the District of Columbia, or possession of the United States, to avoid prosecution for a felony or to avoid giving testimony in any criminal proceeding or
(2) who has fled from any country other than the United States and is avoiding lawful extradition back to that country.
"Crime of violence" means any offense, as defined in title 37, that involves injury or threat of injury to the person of another.
Title 37 is the Hawaii Penal Code.
Examples of crimes of violence include felony offenses against the person (see HRS chapter 707) and misdemeanor offenses such as Assault, Terroristic Threatending, and Harrassment if they involve injury or threat of injury to any person.
